General and Post production

Should one or more of the below mentioned clauses be or become invalid, this does not affect the validity of the remaining clauses.

Unless otherwise specified, any rates on quotations do not include German VAT. Quotations are valid for 4 weeks, starting from the quotation date. Quotations are estimates and are not guaranteed. The estimate is based on information provided by the client regarding project requirements. The final invoice will be based on the actual services provided. All costs marked with * will be charged according to expenditure.

Quotations are only valid for the client/contractual partner as mentioned on the quote (or in the e-mail). A valid, legally binding invoice address must be provided. In order to finalize a reservation / booking with EBS Productions GmbH & Co. KG, the client has to confirm the quotation.

EBS Productions GmbH & Co. KG reserves the right to ask for pre-payment after the project has been confirmed. For projects that require several work periods, EBS Productions GmbH & Co. KG reserves the right to issue partial invoices accordingly. Until full payment has been made, any files/tapes/recordings/production masters remain property of EBS Productions GmbH & Co. KG.
 

Private photo and video recordings do not require permission. Should these be published, e.g. on social media, prior permission from EBS Productions GmbH & Co. KG is required. For commercial use, written consent from EBS Productions GmbH & Co. KG is mandatory in advance. The publication of the resulting photo and video material must always be agreed with EBS Productions GmbH & Co. KG.

 

Recording at EBS

A recording day is based on max. 10 hours work per day (in-out). Unless otherwise agreed, overtime will be charged at 10% of the daily rate per hour(s) overtime. A half recording day is based on max. 5 hours work per day (in-out). Unless otherwise agreed, overtime will be charged at 20% of the half-day rate per hour(s) overtime. Unless otherwise agreed, any additional time required to set up a session will be charged on an hourly basis.
 

When renting premises of EBS Productions GmbH & Co. KG, please note the following opening hours: Mon-Fri 8am-6pm. Production times that extend beyond the opening hours may have to be supervised by an additional employee/doorman, who will be charged at cost.
 

Should the client plan to engage additional trades (e.g. video team), this is only permitted in consultation with EBS Productions GmbH & Co. KG. For this purpose, the customer must fill out a form for the intended use of the photographic material. In the case of a video production, the EBS Productions GmbH & Co. KG reserves the right to charge an additional fee for the photo/video rights buy-out. Should one or more of the above mentioned clauses be or become invalid, this does not affect the validity of the remaining clauses.
 

The cost of piano tunning increases by 100% on Sundays and public holidays.
 

EBS Productions GmbH & Co. KG reserves the right to charge the following positions, if the client cancels a confirmed project

• up to four weeks in advance: all out-of-pocket costs and all hours spent on preparation;
• up to two weeks in advance: all out-of-pocket costs, all hours spent on preparation and 30 % of the agreed rate;
• up to one week in advance: all out-of-pocket costs, all hours spent on preparation and 50% of the agreed rate;
• less than one week in advance: all out-of-pocket cost, all hours spent on preparation and 80% of the agreed rate;

 

If a cancelled recording is postponed to a new date within the following 12 months, the cancellation fee will be deducted from the bill for this project.

Recording Meistersaal

A recording day is based on max. 10 hours work per day (in-out). Unless otherwise agreed, overtime will be charged at 10% of the daily rate per hour(s) overtime. Unless otherwise agreed, any additional time required to set up a session will be charged on an hourly basis.

When renting EBS Productions GmbH & Co. KG premises, the client will return the rented property to its original state and swept-clean before the end of the rental period. EBS Productions GmbH & Co. KG reserves the right to charge for any cleaning costs, if the client does not return the rented property in its original state. With the booking, the client confirms to have taken out a sufficient liability insurance. Within the scope of the legal regulations, the client is liable for all damages, which have unequivocally been caused within their area of responsibility.
 

! The following applies to the Meistersaal specifically: Should the client plan to engage additional trades (e.g. video team), this is only permitted in consultation with EBS Productions GmbH & Co. KG. For this purpose, the customer must fill out a form for the intended use of the photographic material. In the case of a video production, the Meistersaal/BESL reserves the right to charge an additional fee for the photo/video rights buy-out. Adjacent rooms, such as the Green Salon, the Smokers' Lounge and bathrooms, are explicitly excluded from the rental property. EBS Productions GmbH & Co. KG reserves the right to charge for any cleaning costs, if the client does not return the rented property in its original state.
 

EBS Productions GmbH & Co. KG reserves the right to charge the following services, if the client cancels a confirmation project.

• up to two weeks in advance: all out-of-pocket costs, in particular 100% of the Meistersaal rent , all hours spent on preparation and 30% of the agreed rate;
• up to one week in advance: all out-of-pocket costs, in particular 100% of the Meistersaal rent, all hours spent on preparation and 50% of the agreed rate;
• less than one week in advance: all out-of-pocket cost, in particular 100% of the Meistersaal rent, all hours spent on preparation and 80% of the agreed rate;

If a cancelled recording is postponed to a new date within the following 12 months, the cancellation fee will be deducted from the bill for this project. This does not apply to the Meistersaal rent.

Location recordings

A recording day is based on max. 10 hours work per day (in-out). Unless otherwise agreed, overtime will be charged at 10% of the daily rate per hour(s) overtime. A half recording day is based on max. 5 hours work per day (in-out). Should any travel day or set-up day, that is labelled as a half day in your quotation, turn out to involve more than 10 working hours, EBS Productions GmbH & Co. KG reserves the right to charge a full working day.
 

EBS Productions GmbH & Co. KG reserves the right to ask for pre-payment after the project has been confirmed. Any expected travel and transport costs as well as the fee for project planning are due upon project confirmation. For projects that require several work periods, EBS Productions GmbH & Co. KG reserves the right to issue partial invoices accordingly. Until full payment has been made, any files/tapes/recordings/production masters remain property of EBS Productions GmbH & Co. KG.

The client is responsible for the security of EBS Productions GmbH & Co.KG equipment on site. Should there be no possibility to safely lock the premises, the client must hire a professional security service.

Vinyl / Disc cutting

EBS Productions GmbH & Co. KG reserves the right to ask for pre-payment after the project has been confirmed. For projects that require several work periods, EBS Productions GmbH & Co. KG reserves the right to issue partial invoices accordingly. Until full payment has been made, any files/tapes/recordings/Lacquers/production masters remain property of EBS Productions GmbH & Co. KG.
 

By placing an order, the client confirms that they are authorized to order a duplication of the program material. EBS Productions GmbH & Co. KG is not responsible to verify this.
 

EBS Productions GmbH & Co. KG is not responsible for any defects or errors in the supplied source material or additional info, such as track lists, PQ sheets, etc. nor for any errors that occur due to upload or download issues.
 

EBS Productions GmbH & Co. KG reserves the right to, but is not required to store any digital files for any amount of time.
 

We strongly recommend to have test pressings made. Otherwise we cannot take responsibility for any errors on the final product.
 

 

File delivery specs for vinyl:

1) Program material: Please provide your files either as a ZIP-compressed folder or include an MD5 checksum, otherwise we can not guarantee a faultless file transfer.
 

2) One file per side: please name the files A, B, C, D…

or one file per track: please name the files according to track number on the respective side. As an example: the second track on the B-side would be named “B2”.
 

3) Please provide the catalogue number(s).
 

4) Include a PDF or TXT track list to prevent errors in track succession and side split.
 

5) Provide the invoice address and e-mail address of the invoice recipient.
 

6) Let us know which pressing plant to send the lacquers to. Please confirm that the pressing plant is awaiting the lacquers.
 

7) Please note that the time needed for necessary inquiries (e.g. billing address, shipping address, catalogue number, etc.) will be charged as studio time.
